The latest Foxwoods venture hit a bit of a snag recently when the Pennsylvania Supreme Court rejected its request to expedite various zoning approvals from the city, which would allow the project to break ground.
The court issued a one-paragraph denial last week.
The high-court ruling comes as a surprise as another casino project, SugarHouse, filed a similar claim and received a favorable ruling earlier this month.
Foxwoods has already obtained Planning Commission approval, but still needs several building and zoning permits from the city.
Both casinos have complained that the city has delayed their projects, and appealed to the high court for help in the form of “expedited treatment” that would allow them to bypass the arduous zoning process and begin construction.
Foxwoods also has a case against the city pending in the Philadelphia Common Pleas Court.
Foxwoods officials are reviewing their legal options, according to a spokeswoman, and may file another appeal to the Pennsylvania Supreme Court.
“We are confident that we are entitled to the same relief granted to SugarHouse based on the Supreme Court ruling in that case,” said Maureen Garrity, the project spokeswoman.
Foxwoods Philadelphia is planned for a 16.5-acre parcel in South Philadelphia along the Delaware River and would cost nearly $1 billion. The 3.7-million-square-foot waterfront project would be constructed in three phases and includes 5,000 slot machines, a 500-room hotel, a 21,000-square-foot spa, restaurants, retail shops and entertainment space.
